Terms and
Conditions
The
Clegs Club Membership is operated by Clegs ABN 30 315 283 279. Each member of
the Clegs Club is bound by these Terms and Conditions.
1.
Each application for membership of the Clegs Club is subject to
acceptance by Clegs in its absolute discretion.
2.
Clegs Club membership is only activated on receipt by Clegs of a fully
completed and signed application form.
3.
Only individuals can apply for Clegs Club membership. Corporations,
partnerships, trusts and other entities are not eligible to participate in the
Clegs Club.
4.
A Clegs Club member may only hold one Clegs Club Card. Clegs Club
membership and cards cannot be held jointly.
5.
Employees of Clegs are not eligible to participate in the Clegs Club.
6.
One point will be earned for every whole dollar spent at participating
Clegs stores, or Clegs online on Eligible Purchases. Clegs may also offer bonus
Points from time to time on terms set by Clegs in its absolute discretion.
7.
Clegs Club Points will be earned with every Eligible Purchase made at any
participating Clegs store on presentation of a Clegs Club Card, or at Clegs
online on entry of a Clegs Club Card number and password details, subject to
terms set by Clegs from time to time at its absolute discretion.
8.
A Clegs Club Card must be presented, or Clegs Club Card number and
password details entered at Clegs online at the time of sale for Clegs Club
Points to be earned.
9.
Clegs Club Points will be allocated to the Clegs Club member account
within 24 hours after each Eligible Purchase, subject to specific promotion
terms and system availability.
10.
Clegs Club Points cannot be transferred.
11.
Active Clegs Club members will receive regular Clegs Club communications
showing Clegs Club balances.
12.
Clegs Club Points will expire two years after issue. During this time the
points will continue to be available for redemption while the Clegs Club is
operating and the relevant Clegs Club Member Account remains open and active.
13.
Clegs Club Points will not be earned on the purchase of a Clegs gift
voucher and cannot be redeemed to buy a Clegs gift voucher. However Clegs Club
points may be earned when using Clegs gift vouchers for payment for Eligible
Purchases.
14.
The Clegs Club will have Green, Silver and Gold tiers of membership,
which attract different entitlements. All new members will be Green members. To
migrate to Silver a member must spend $3000 and make at least six purchases
within a consecutive 12 month period. To migrate to Gold a member must spend
$5000 and make at least six purchases in a 12 month period. Silver and Gold
members must maintain these minimum amounts within following consecutive 12
month periods to maintain their Silver and Gold memberships. Silver and Gold
memberships will not accumulate points. Silver memberships will receive 10%
discount off Eligible Purchases at time of sale. Gold memberships will receive a
20% discount at time of sale. Clegs reserves the right to change the tiers of
membership, the qualifications for joining or remaining in a tier and the
membership entitlements for each tier, from time to time.
15.
Clegs Club members that have White Clegs Club Cards, as at 31st
March 2011 will continue to receive 10% off storewide and 25% off sewing
patterns (some specials excluded). Points will not be earned on purchases made
using a White Clegs Club Card. When Clegs Club members’ White card expires a
Green tiered Clegs Club Card will be issued upon return of a renewal form, with
the Clegs Club members acceptance of these Terms and Conditions as per their
signature on the returned form. New White cards will not be issued after 31st
March 2011. Clegs Club members that have a White card may choose to change their
membership to Green at any point before the expiry of their White membership.
Once Clegs has received the form with the member’s signature to accept these
Terms and Conditions their membership will be changed to Green and will operate
as per these Terms and Conditions.
16.
Clegs Club Points are earned at the rate of 1 Point per dollar, and can
only be redeemed with a minimum 200 Points accumulated. At redemption 200 Points
equals $20 discount. Any part thereof can be redeemed at a time, however if the
Points fall below 200 the Clegs Club member must wait for the Points to reach
200 again before redeeming them.
17.
Clegs Club Points are redeemable by presenting a valid Clegs Club Card at
the time of purchase at any participating Clegs store or enter the Clegs Club
Card Number and password to make a purchase online.
18.
Clegs Club Points can only be redeemed for goods sold at participating
Clegs stores or at Clegs online.
19.
No change will be given for purchases valued at less than the face value
of the Clegs Club Points you redeem.
20.
Clegs Club Points cannot be redeemed for cash.
21.
Refunds will only be provided for goods purchased using a Clegs Club Card
in accordance with Clegs Refunds and Exchange policy. In the event of a refund,
any Clegs Club Points earned for the original purchase will be deducted from the
Clegs Club account, and if purchased using redeemed Clegs Club Points in partial
or full payment, Clegs Club Points will not be refunded.
22.
Your membership details are personal information for the purposes of the
Privacy Act.
23.
Personal information will only be used for the purpose of the Clegs Club
and by Clegs, and third party printing companies for marketing and promotion.
24.
Your Clegs Club online password must not be disclosed to any other
person.
25.
Clegs reserves the right to suspend or terminate the Clegs Club at any
time by providing not less than 90 days notice to members delivered to the
members’ last known point of contact.
26.
Membership in the Clegs Club may be terminated immediately by Clegs if
Clegs has reasonable grounds to suspect that a Clegs Club member has shoplifted
or defrauded Clegs or the Clegs Club in any way.
27.
Clegs may terminate any membership of the Clegs Club without notice, if
the relevant member – 1. Fails to comply with these Terms and Conditions, 2.
Engages in misleading conduct in connection with the Clegs Club; or 3. The
member does not use his or her membership card for a period of 12 months, or
dies or becomes bankrupt.
28.
A member may terminate his or her membership in the Clegs Club at any
time by giving written notice to Clegs.
29.
All Clegs Club cards remain the property of Clegs.
30.
Clegs is not responsible for stolen or lost Clegs Club Cards. Please
report all lost or stolen cards immediately and Clegs will issue you with a new
card.
31.
To the extent permitted by law, any liability that Clegs may have to a
member in any way to the Clegs Club whether for negligence, breach of contract
or otherwise is limited by – 1. In the case of any claim relating to points, to
crediting the relevant number of points to the member’s account; and 2. In any
other case, to a maximum of $.10 for each point in the member’s account at the
time the liability arose.
32.
Clegs may make any changes at any time in its absolute discretion, to
these Terms and Conditions. Clegs will endeavour to provide at least 90 days
notice of any such changes.
33.
Where Clegs is required to give notice under these Terms and Conditions,
notice may be given by written/email notice direct to the last known contact of
Clegs Club members, or with the Terms and Conditions here.
34.
Clegs may suspend or cancel the membership of any Clegs Club Member with
overdue payments owing on laybys or accounts.
